Macbook Core 2 duo Bulging Battery

Hi My Dad's Macbook 4.1 intel core 2 duo's battery has bulged underneath. . Is this a known about product fault for this models serial number? 

It will not charge and it is also inhibiting the use of the track pad button.

My Dad was encouraged to take out Applecare but never used it. This has now expired. Is it possible that this is a fault that Apple will repair or supply a new battery due to it being a common problem?
