MacBook brand new battery "needs service"

I just got a brand new battery for my MacBook and it is not holding a charge, says it needs servicing, and also says that it is not charging. The battery must have been able to charge some because ealier today it was at 43%, and now it is at 76%. I don't know why I am having this problem!
